Liability Waiver and Release

By purchasing and using this product, the purchaser and/or user (hereinafter referred to as “User”) agrees to the following terms and conditions:

1. Assumption of Risk: The User acknowledges that by using this product, there may be risks of injury or damage, whether foreseeable or unforeseeable. The User assumes full responsibility for any and all risks associated with the use of the product.

2. Release of Liability: The User agrees to release, waive, and discharge The BreakroomTCG, its officers, employees, agents, and affiliates from any and all liability for any loss, damage, injury, or claim, including but not limited to personal injury, property damage, or any other damages that may arise from the use or misuse of the product.

3. Indemnification: The User agrees to indemnify, defend, and hold harmless The BreakroomTCG from and against any and all claims, liabilities, damages, costs, and expenses, including legal fees, arising out of or in connection with the User’s use of the product.

4. No Warranties: The BreakroomTCG makes no warranties, either express or implied, regarding the product’s performance, functionality, or safety. The product is provided “as is,” and the User accepts full responsibility for its use.

5. Limitation of Liability: In no event shall The BreakroomTCG be liable for any indirect, incidental, special, or consequential damages, or any damages arising from the User’s use of the product, even if The BreakroomTCG has been advised of the possibility of such damages.

6. Governing Law: This agreement shall be governed by and construed in accordance with the law, and any dispute arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the court.
